A. Review of Trust (Non-Special Treatment) at Reapplication
In some instances a customer may need to spend down trust (non-special treatment) assets to establish eligibility and then reapply. In this instance, proceed as follows:

There has been no change in the trust document |
There is no need to perform another review of the trust other than to verify current trust assets. |
The trust document has been revised |
Refer the trust to Central Office, Program Support Administration for review. |
B. Review of Trust (Special Treatment) at Reapplication
A customer with a Special Treatment Trust may reapply after being determined ineligible for ALTCS because the customer or representative did not provide all of the information needed for the Office of Administrative Legal Services or Central Office, Program Support Administration to determine if the trust qualifies for special treatment.
If this occurs, obtain the following items:
A new Special Treatment Trust Anticipated Disbursements form (DE-312) or Income Only Trusts Anticipated Disbursements form (DE-313), whichever is applicable;
A new Acknowledgment of Responsibilities as Trustee for a Special Treatment Trust form (DE-522), signed by the trustee; and
Trust account records since the last review.
Refer the trust to Central Office, Program Support Administration for review with these items attached to the referral.
